§ 1 Provider and scope

(1) supinion is provided by TELEPANO, owner: Noel Weinberg (brand 1337 Studios), sole proprietorship, Eurotec-Ring 15, 47445 Moers, Germany, email hi@supinion.com ("we"). All further details are in the imprint.

(2) These terms apply to any use of supinion free of charge: the Free plan, the trial and trying it out without an account. They apply to private individuals and organisations alike. For paid plans, the terms and conditions for organisations or the terms and conditions for consumers apply in addition.

(3) Participants join sessions without an account via QR code or access code. The rules on prohibited content (§ 3) and moderation (§ 4) apply to their contributions.

§ 2 Use free of charge

(1) supinion is a web application for live polls, quizzes, Q&A, scales, word clouds and presentations. Use free of charge costs nothing and does not turn into a paid plan.

(2) Free: 50 participants per month and workspace, at most 5 quiz and 3 other questions per presentation, with a supinion notice in the presentation.

(3) Trial: 14 days with the features of Pro, no payment method. It ends automatically; after that, Free applies.

(4) Trying it out without an account: presentations are kept for 7 days. Creating an account keeps them permanently.

(5) There is no entitlement to a specific availability or a specific scope of the free use. We announce significant restrictions to users with an account by email at least six weeks in advance.

§ 3 Prohibited content

(1) Users are responsible for the content of their presentations and contributions.

(3) It is also prohibited to misuse supinion, in particular to overload the technology, circumvent protective mechanisms or generate answers automatically en masse.

§ 4 Moderation and reports

(1) Word filter: An automatic word filter holds back participant contributions containing offensive terms. They are not deleted but not shown. The filter may hold back contributions wrongly or miss some.

(2) Moderation by presenters: Presenters can hide and release contributions in their sessions themselves.

(3) Reports: Every participant view has a "Report content" function. Reports are reviewed by people, not by automated systems. We decide in a timely, diligent and objective manner.

(4) Measures: After a report or on our own knowledge we may close the report without a measure, remove a session with its results or block a workspace. We choose the mildest suitable measure. In case of removal and blocking, those affected receive a statement of reasons with the facts, the rule or legal basis concerned, and the available remedies (Art. 17 of Regulation (EU) 2022/2065).

(5) Complaint: A decision under paragraph 4 can be challenged free of charge by email to hi@supinion.com within six months. Complaints are reviewed by people. If the measure proves unfounded, we lift it. Recourse to the courts remains open.

§ 5 Rights to content

(1) Content remains with those who create it. They grant us the rights we need to provide supinion – that is, to store, back up, process and display content to participants.

(2) We do not use content or answers for our own purposes, in particular not for advertising.

(3) Templates we provide may be freely used and adapted for one's own presentations.

(4) Anyone who uploads or enters content – such as texts, images, logos or PDF slides – warrants that they hold the necessary rights to it and, where required, have obtained the consent of the persons depicted or named. Anyone who breaches this obligation in a manner for which they are responsible indemnifies us against third-party claims based on that breach, including reasonable costs of legal defence.

§ 6 Data protection and data processing on behalf

(1) How we handle personal data is described in the privacy policy.

(2) If an organisation uses supinion free of charge, or someone uses supinion for an organisation, for example a teacher in their school's lessons, we process the participants' answers on behalf of the controller. Our data processing agreement (German only) applies to this; it forms part of these terms of use. On request we also conclude it with signatures.

§ 7 Liability

(1) For use free of charge we are only liable for intent and gross negligence.

(2) This limitation does not apply to injury to life, body or health, under the German Product Liability Act, or to fraudulently concealed defects. In these cases we are liable in accordance with the statutory provisions.

§ 8 End of use

(1) The account can be deleted in the app at any time. This ends the use.

(2) We may end the free use with six weeks' notice. The right to block immediately in case of serious or repeated violations of § 3 (§ 4 para. 4) remains unaffected.

§ 9 Changes to these terms

We announce changes to users with an account by email at least six weeks before they take effect. For continued use after they take effect, we ask for consent in the app. Anyone who does not consent can delete their account; content can be saved beforehand if the plan includes an export.

§ 10 Final provisions

(1) The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.

(2) The place of jurisdiction for merchants, legal entities under public law and special funds under public law is Moers, Germany.

(3) The German version is legally binding.
